Maritime Law Attorneys
Maritime Law was set up to protect the rights of workers, sailors, and ship passengers. These complex laws allow for injury victims to seek compensation for damages caused by either negligence or unseaworthy vessels. Since working on and around the water can be very hazardous, it is extremely important to the workers and their families that these laws be upheld.
Maritime law is just as extensive as other personal injury laws. Over the years, this law has been expanded to protect not only the individuals on boats, but also longshoremen, dock workers and offshore oil field workers. Maritime law includes:
- Jones Act – The Jones Act protects members of a crew of a ship or vessel and offshore workers. It allows employees who have been injured from negligence by their employers to seek compensation for damages. The Act also protects them against employer retaliation.
- Death on the High Seas Act (DOHSA) – DOHSA is a federal law that gives the surviving family members the right to collect damages in the form of the deceased worker's future earnings.
- Longshore and Harbor Workers' Compensation Act (LHWCA) – This act covers dock workers and other maritime workers who are not covered by the Jones Act.
- Unseaworthiness Claims – Unseaworthiness claims apply to injuries that are caused by a faulty vessel or faulty machinery. This also covers damages caused by a crew if they are found to be incompetent or unskilled for their assigned work. The owner of the vessel has a responsibility to provide and maintain a seaworthy vessel.
